Summary

The dossier concerns the law applicable to the third-party effects of assignments of claims. The amendments lay down conflict-of-laws rules designating the national law governing the proprietary effects of assignments, generally the law of the assignor's habitual residence with the law of the assigned claim as an exception, to provide legal certainty in the internal market while supplementing the Rome I Regulation, and address securitisation, financial instruments and consumer protection.
