Suspending the application of the rules on extended producer responsibility for batteries and waste batteries and packaging and packaging waste (Omnibus VIII on environmental legislation)
This procedure temporarily suspends the extended producer responsibility rules requiring producers to appoint an authorised representative for batteries and packaging (Omnibus VIII on environmental legislation). Amendments vary who benefits, from micro-enterprises only to micro and small or small and medium producers as defined in Directive 2013/34/EU, and set different end dates (31 December 2027, 1 January 2029 or 2035, or the entry into force of the forthcoming Circular Economy Act). They target the suspension of Article 56(3) of Regulation (EU) 2023/1542 and Article 45(3) of Regulation (EU) 2025/40 to Union-established producers, while preserving the mandatory authorised representative for producers established in third countries to ensure traceability and enforcement.
