Trade marks: approximation of the laws of the Member States. Recast

The dossier is a recast directive approximating Member States' trade-mark laws. The amendments address the proprietor's right to stop counterfeit goods entering the customs territory from third countries, including goods in transit and sales over the Internet, the trade mark's function of guaranteeing origin, freedom of expression and comparative or non-commercial use, exhaustion of rights, registration and opposition procedures before national offices, and cooperation between offices and the Agency.
