A directive on protecting undisclosed know-how and business information (trade secrets) against unlawful acquisition, use and disclosure. The amendments address the knowledge economy, open innovation and worker mobility, align national rules across the internal market, reference the TRIPS Agreement and the World Trade Organisation, exclude independent discovery and honest practices, address public bodies, procurement disclosures and litigation confidentiality, and apply proportionality to remedies against goods made using a trade secret.
