Application of Directive 2004/35/EC on environmental liability with regard to the prevention and remedying of environmental damage ('ELD')

The dossier reviews the application of Directive 2004/35/EC on environmental liability with regard to the prevention and remedying of environmental damage. Amendments call for revising the directive, clarifying the definition of environmental damage, extending strict liability to non-Annex III activities and to harm to human health, addressing financial security for operators, the polluter-pays principle, permit and state-of-the-art defences, and divergent implementation across Member States.
